Thank you for choosing Indulgent Retreats Pty Ltd. This document embodies all of the terms and conditions of the agreement between you ("the customer") and Indulgent Retreats Pty Ltd ("Indulgent Retreats").

By proceeding with your booking, you hereby acknowledge having read and understood the following terms and conditions, and agree to be bound by them.

General

1. Indulgent Retreats is not a travel agent, carrier, keeper of inns, hotels, refreshment, boarding or lodging houses. Indulgent Retreats will arrange accommodation, meals and activities, and every care is taken in the selection of service providers, however please note that bookings are subject to the terms and conditions and limitation of liability imposed by the service providers themselves, and Indulgent Retreats assumes no liability in relation to the acts of any such service provider.

2. Indulgent retreats reserves the right to refuse any booking, and the information in this website does not constitute an offer in relation to the services or pricing referred to as prices are subject to fluctuation due to matters beyond the control of Indulgent Retreats, and can only be confirmed at the time of booking.

Payment

3. Subject to the following, a non-refundable deposit must be paid at the time of booking as follows:

(a) Domestic (within Australia) $300.00

(b) International $1000.00

Bookings cannot and will not be held until the deposit has been received. In the event that a package is unavailable, the customer will be notified and the deposit refunded in full.

4. The balance of the package fee (being the price less the deposit paid) must be received by Indulgent Retreats no later than 30 days prior to the commencement date of the package. Failure to make payment in full by this time may result in the cancellation of the booking and forfeiture of deposit at the sole and absolute discretion of Indulgent Retreats.

Cancellation

5. In the event of cancellation after the deposit is paid, and prior to the payment of the balance of the booking then the deposit will be forfeited in full.

6. In the event of cancellation after the payment of the full package price, then the following cancellation fees will be payable:

(a) Domestic (within Australia):
30 days or more prior to commencing date 50% of total
15 - 29 days prior to commencing date 60% of total
14 days or less prior to commencing date 100% of total

(b) International
30 - 60 days prior to commencing date 30% of total
30 days or less prior to commencing date 100% of total

in this clause, the term "total" shall mean the total package price.

In the sole and absolute discretion of Indulgent Retreats, any monies forfeited pursuant to Clauses 4, 5 or 6 above may be credited to any further bookings made within 6 months from the date of cancellation of the original booking.

Availability of Services

7. All packages are subject to availability and payment of deposit as required above. Indulgent Retreats makes no representation or warranty in relation to the availability of packages generally.

Suitability of Services

8. Whilst every effort is taken by Indulgent Retreats to ensure that the information provided on this website is accurate and up to date, the information provided by Indulgent Retreats on this website and any promotional material does not constitute advice and no warranty is given as to the accuracy, suitability or reliability of such information. In particular, and without limiting the generality of the foregoing, Indulgent Retreats takes no responsibility for the suitability of the information provided or the services offered for the customer's particular circumstances.

Responsibility of the Customer

9. It is the responsibility of the customer to obtain all passports, health checks, inoculations, visas or other necessary documentation in order to allow the customer to take part in the package. Indulgent Retreats strongly recommends that the customer arrange travel insurance with a reputable insurer.

Pricing

10. All prices quoted are in Australian Dollars and include Goods and Services Tax where applicable. Prices are calculated on a "per person twin share" basis. Please contact Indulgent Retreats for further information should you be a solo traveller as this may result in a supplemental charge.

11. In relation to international packages, prices may fluctuate depending on currency exchange rate fluctuations, and Indulgent Retreats reserve the right to recover from the customer additional charges due to such currency exchange rate fluctuations.

Website

12. The Indulgent Retreats website contains links to the websites of third parties who may be in no way related to indulgent Retreats. Indulgent Retreats makes no warranty in relation to any information provided via the websites referred to in this clause that are maintained by third parties.

13. The Indulgent Retreats website is maintained and hosted by a third party service provider and consequently Indulgent Retreats makes no warranty in relation to the availability of the website.

Copyright

14. The information contained in this website including any logos and images remains the property of Indulgent Retreats. The customer may download and/or print a single copy for non-commercial use however all other rights granted by the Copyright Act 1968 and the general law of copyright are reserved.

Privacy

15. Indulgent Retreats values your privacy, and undertakes to comply with the Privacy Act, 1988. Depending on the type of service, we may collect information about the customer including but not limited to name, address, contact details, date of birth, drivers licence number and expiry date, and credit card number and expiry date. We may disclose such information to third party service providers including accommodation service providers, but will only do so where necessary to complete the arrangement of your package.

Miscellaneous

16. This Agreement is governed by the laws of New South Wales. Each party irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales.

17. The failure to exercise or enforce any rights under this agreement does not constitute a waiver of that right unless specifically stated in writing.

18. Should any provision of these terms and conditions be void or unenforceable for any reason then the remaining terms shall, to the extent possible, remain valid and enforceable.
